Scratch Skating Terms of Service

Welcome to Scratch Skating! The Terms of Service("ToS") applies to your access and use of the web app, including, but not limited to, the APIs and other back-end services, emails, in-app purchases, and other products and services (collectively, the "Services") provided by Scratch Skating, LLC. ("Scratch Skating", "we", "us", or "our").

  • 1. Beta Testing Purpose

    The purpose of this Beta Testing Agreement is to allow selected users to test the Scratch Skating platform ("the Platform") during its beta phase. By participating, you agree to test all features of the platform, including but not limited to:

    • Creating posts with text, images, and videos.
    • Liking and disliking posts and comments.
    • Customizing your profile and interacting with social features within the app.
    • Customizing your avatar and using in-app digital currency.

    Your participation will help us identify bugs, issues, and gather feedback to improve the platform before its official release.

  • 2. Confidentiality

    By participating in the beta test, you agree to maintain the confidentiality of certain aspects of the platform, while having the ability to share your general experiences. You agree to:

    • Share Publicly:

      You are allowed to share your personal experiences, feedback, and general impressions of the platform publicly, including through social media, blogs, and forums. However, you must not disclose specific features, content, or details of the platform that are confidential or not yet released.

    • Prohibited Disclosures:

      You will not disclose or share detailed information about any unreleased features, bugs, or issues encountered during testing, unless explicitly authorized by Scratch Skating. This includes any internal workings, performance issues, or other aspects that are not intended for public knowledge.

    • Competition Restrictions:

      You agree not to share any information gained through the beta test with potential competitors or use such information to create, develop, or enhance a competing application or platform. This includes any features, concepts, or ideas that could be used to replicate or compete with the Scratch Skating platform.

    • Screenshots and Recording:

      You may take and share screenshots or recordings of your general experience, but you are prohibited from capturing and sharing any sensitive or unreleased aspects of the platform that are confidential.

    • Test Data Usage:

      Any feedback, bug reports, or data shared with Scratch Skating belongs to Scratch Skating and may be used to improve the platform. You will not use the information gathered during the beta testing for personal gain or commercial purposes.

    Your participation will help us identify bugs, issues, and gather feedback to improve the platform before its official release.

  • 3.

    Testing Feedback and Reporting

    As a beta tester, you are encouraged to provide feedback on your experience with the platform and report any issues or bugs you encounter. By participating, you agree to the following:

    • Providing Feedback:

      You are encouraged to provide feedback on the platform’s features, performance, and usability. However, you are under no obligation to provide feedback or report issues.

    • Reporting Bugs and Issues:

      If you encounter any bugs, glitches, or issues, you are welcome to report them, but there is no requirement to do so. Reporting issues is optional, and you can choose not to report anything you encounter.

    • Feature Requests:

      You may suggest new features or improvements to the platform, but Scratch Skating is under no obligation to implement any of these suggestions. All feedback, including feature requests, becomes the property of Scratch Skating.

    • Testing Participation:

      You are free to stop using the app at any time without notifying Scratch Skating. There is no formal opt-out process required.

    • Timeliness of Reporting:

      While it’s helpful to provide detailed reports, you are not required to provide reports within a specific timeframe.

  • 4.

    Access and Limitations

    As a beta tester, you will be granted access to the Scratch Skating platform under the following terms:

    • Beta Access:

      You will be granted temporary access to the platform during the beta testing phase. This access is provided solely for the purpose of testing the platform's features and functionality.

    • Limitations of Access:

      Access to certain features, content, or services within the platform may be restricted or subject to change during the beta phase. Scratch Skating reserves the right to limit or modify your access at any time without notice.

    • Suspension of Access:

      Scratch Skating may suspend or terminate your access to the platform at its sole discretion if you violate any terms of this agreement or engage in any activities that are deemed harmful to the platform or other users.

    • Availability of Features:

      Some features or aspects of the platform may be incomplete or subject to change during the beta phase. Scratch Skating makes no guarantee that all features will be fully functional or available for the entirety of the beta period.

    • No Ownership Rights:

      Participation in the beta testing phase does not grant you any ownership or rights to the platform, its content, or any intellectual property. All rights to the platform and its content remain with Scratch Skating.

    • Account Security:

      You are responsible for maintaining the security of your account and any credentials provided to you during the beta test. You agree not to share your login information with any third parties.

  • 5.

    Data and Assets Retention

    • No Guarantee of Data Retention:

      Scratch Skating will make reasonable efforts to retain your account data, including user-generated content and assets purchased or earned during the beta testing period. However, Scratch Skating makes no guarantee that any data, assets, or purchases will be retained after the beta phase ends.

    • Beta Data and Assets:

      You understand and acknowledge that any data, including but not limited to posts, comments, images, videos, and digital assets (such as the Platform’s digital currency or avatar items), may not persist after the beta period. You should not expect that your account data or assets will carry over into the final version of the platform.

    • Account Data:

      While Scratch Skating intends to retain account data where possible, there is no guarantee that all account-related information will be preserved. Scratch Skating is not responsible for any loss of data or assets during or after the beta testing period.

    • No Financial Responsibility for Loss:

      Scratch Skating is not financially liable for any losses incurred from the loss of data, assets, or purchases during or after the beta phase.

  • 6.

    Indemnity and Limitation of Liability

    • Indemnity:

      You agree to indemnify, defend, and hold harmless Scratch Skating LLC, its affiliates, employees, contractors, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from:

      • Your use or inability to use the platform, including any bugs or errors;

      • Your violation of any terms of this agreement;

      • Your infringement of the intellectual property rights of any third party;

      • Any other actions or behavior on your part that cause harm to the platform, its users, or its services.

    • Limitation of Liability:

      Scratch Skating LLC and its affiliates, employees, contractors, agents, and representatives shall not be held liable for any direct, indirect, incidental, consequential, or special damages resulting from:

      • Your use or inability to use the platform, including any bugs or errors;

      • Any loss or damage to data, content, or assets;

      • Any third-party claims, including those related to the use of the platform;

      • Any interruptions or delays in the platform's availability.

    • No Warranty:

      The platform is provided on an "as-is" and "as-available" basis. Scratch Skating LLC makes no representations or warranties of any kind, express or implied, regarding the platform's reliability, accuracy, availability, or functionality. Scratch Skating does not warrant that the platform will be free from errors, interruptions, or defects.

    • No Liability for Beta Test Data Loss:

      Scratch Skating shall not be liable for any loss or corruption of data, including but not limited to user posts, content, or purchases made on the Platform, that may occur during or after the beta phase.

  • 7. Miscellaneous

    • Governing Law:

      This agreement shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles. Any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts in San Mateo, California.

    • Severability:

      If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be replaced with a valid, enforceable provision that closely matches the intent of the original.

    • Amendments:

      Scratch Skating reserves the right to amend, modify, or update these terms at any time, with or without notice. Any changes to this agreement will be effective upon posting the revised terms on the platform or through other communication channels. Your continued use of the platform after such modifications constitutes your acceptance of the updated terms.

    • Entire Agreement:

      This agreement constitutes the entire understanding between you and Scratch Skating regarding your participation in the beta testing phase. It supersedes all prior or contemporaneous communications, whether oral or written, regarding the subject matter of this agreement.

    • Force Majeure:

      Scratch Skating shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, government regulation, natural disasters, or technical failures.

    • No Waiver:

      Failure by Scratch Skating to enforce any provision of this agreement shall not be deemed a waiver of future enforcement of that or any other provision.

    • Transferability:

      You may not assign, transfer, or sublicense any of your rights or obligations under this agreement without the prior written consent of Scratch Skating. Scratch Skating may assign or transfer its rights under this agreement at any time without notice.

    • Headings:

      The headings used in this agreement are for convenience only and shall not affect the interpretation of any provision.

  • 8.

    Acceptance of Terms

    By participating in the Scratch Skating beta testing phase, you acknowledge and agree to the terms and conditions outlined in this agreement. Your continued use of the platform, including but not limited to creating posts, liking or disliking content, interacting with the community, and using the platform’s features, constitutes your acceptance of these Terms of Service.


    If you do not agree to these terms, you must cease all use of the Scratch Skating platform immediately.

  • 9.

    Communication and Consent to Email

    By agreeing to these Terms of Service, you consent to receiving communications from Scratch Skating LLC via email. These communications may include, but are not limited to, updates about the beta test, feature announcements, bug reports, changes to the platform, promotional content, and other important information related to the beta testing process.


    You may opt out of receiving marketing communications by following the unsubscribe instructions included in each email. However, you cannot opt out of receiving essential communications related to the beta test, such as critical updates or changes to the platform.
